1. General provisions

The protection and security of personal data is a top priority for Blösch AG (a company of the BCI Blösch Group, referred to as “Blösch AG” in the following). We are committed to openness and transparency. This data privacy statement informs you about the type, scope and purpose of the processing of personal data by us as well as your rights in this context. This description is not exclusive. Specific circumstances may be covered by other data privacy statements or similar documents.

Personal data means any information relating to an identified or identifiable natural person (“data subject”). Data processing means any process carried out in the context of personal data, with or without the help of automated methods, such as collection, recording, storage, changing, querying, using, disclosing by transferring, dissemination or delivery in another form and erasure.

3. Collection, editing and storage of personal data

Blösch AG may process the following categories of personal data. In doing so, Blösch AG does not process more personal data than necessary.

Blösch AG processes customer data. This includes the following in particular:

  • Master and stock data (such as name, address, date of birth, telephone number, contract number and term, information about concluded transactions, bank details)
  • Marketing data (such as needs, wishes, preferences)
  • Technical data (such as internal and external identifiers, business numbers, IP addresses, records of access or changes, e-mail addresses)
  • Blösch AG processes the data of suppliers and other business partners. This includes the following in particular:
  • Master and stock data (such as name, address, date of birth, telephone number, contract number and term, information about concluded transactions, bank details)
  • Marketing data (such as needs, wishes, preferences)
  • Technical data (such as internal and external identifiers, business numbers, IP addresses, records of access or changes, e-mail addresses).

The storage duration for personal data is determined according to statutory retention obligations (five, ten or more years depending on the applicable legal basis) and the respective data processing purpose.

4. Purpose of data processing

Blösch AG may process the personal data described under no. 3 for the purpose of providing its services and in accordance with the applicable laws. This includes in particular the conclusion and performance of contracts, planning and executing production orders and product development, marketing and market research, support, consulting and information about the range of products and services, preparing and providing tailor-made services, purchasing products and services from our suppliers and subcontractors, communication with third parties and handling their enquiries (such as applications, media enquiries), collecting personal data from sources accessible to the public for the purpose of customer acquisition, legal or regulatory obligations to provide information or to submit reports to courts and public authorities, and complying with official orders.

To the extent this is permitted and appears advisable to us, we also reserve the right to carry out video surveillance for the purpose of maintaining domestic authority and to implement other measures for IT, building and plant security and the protection of our employees and other persons as well as the assets owned by or entrusted to us (for example access control, visitor lists, network and e-mail scanners, telephone records).

5. Legal basis of data processing

Data processing is lawful when it is carried out in the context of

a) contract initiation in response to an enquiry from the data subject

b) the performance of a contract or

c) the dissolution of a contract.

Data processing is also lawful when the data subject has given their consent to data processing or when processing is required for Blösch AG to fulfil a contractual or legal obligation. Furthermore, data processing is lawful when it is required to protect the legitimate interests of Blösch AG or a third party. Data processing to protect the vital interests of a natural person or data processing that is necessary for important reasons of public interest is also lawful.

6. Data security

We take appropriate technical and organisational security precautions to protect your personal data against unauthorised access and misuse. These security measures are continuously adapted and improved by us in the course of technological and organisational development.

7. Dissemination of personal data

Blösch AG shall not sell or transfer your personal data to third parties nor otherwise disseminate your personal data, except as described in this data privacy statement.

Your personal data may also be transferred to third parties acting on our behalf or in our name, who process the data according to the purpose(s) for which the data were originally collected or for other lawful purposes. These third parties have made contractual commitments to us to use personal data exclusively for the agreed purposes and not to sell or disclose personal data to other parties unless this is required by law, permitted by us or described in this data privacy statement.

Personal data may also be disclosed to third parties when we are required to do so according to a legal order or when this is necessary to assist criminal or legal investigations or other legal enquiries or proceedings, domestic or foreign.

8. Rights of the data subject

In accordance with the applicable legal provisions, you may request information from Blösch AG at any time whether your personal data are processed by us. If this is the case, we inform you about your personal data contained in our data collection, including the available information about the origins of the data, the purpose and if applicable the legal basis of processing, and the categories of the processed personal data, the parties involved in collection and the data recipients.

You also have the right to correction, the right to the erasure of personal data (to the extent this does not conflict with retention obligations), the right to the restriction of processing, the right to data portability and the right to revoke your consent under data protection law.

9. Data logging when visiting our website

9.1 Data capture on our website

Various personal data are collected when you visit the Blösch AG website. Personal information are data with which you could be personally identified. When visiting our website, statistical analyses may be made of your surfing behavior. Part of the data is collected to ensure the proper functioning of the website. Other data can be used to analyze how visitors use the site.

This happens primarily using cookies and analytics. The analysis of your surfing behavior is usually anonymous, i.e. we will not be able to identify you from this data. There is no dissemination of your data to third parties for commercial or non-commercial purposes. Some data are collected when you provide it to us. This could, for example, be data you enter on a contact form.

Other data are collected automatically by our IT systems when you visit the website. These data are primarily technical data such as the browser and operating system you are using or when you accessed the page. These data are collected automatically as soon as you enter our website.

The Blösch AG website contains links to other websites. Blösch AG is not responsible for the data protection policies or contents of these other websites.

Our site uses SSL or TLS encryption for security reasons and for the protection of the transmission of confidential content, such as the inquiries you send to us as the site operator.

We hereby expressly prohibit the use of contact data published in the context of website legal notice requirements with regard to sending promotional and informational materials not expressly requested. Blösch AG reserves the right to take specific legal action if unsolicited advertising material, such as email spam, is received.

9.2 Cookies

We use cookies on our website to improve its usability. Cookies are small text files that are stored on your hard drive and, depending on your browser settings, are erased again when your browser is closed. Most of the cookies we use are so-called "session cookies." They are automatically deleted after your visit. Other cookies remain in your device's memory until you delete them. These cookies make it possible to recognize your browser when you next visit the site. These cookies do not access any information about you stored on your hard drive and do not harm your PC or your files. Most browsers are configured to automatically accept cookies. These data will not be combined with data from other sources.

9.4 Contact form

Should you send us questions via the contact form, we will collect the data entered on the form, including the contact details you provide, to answer your question and any follow-up questions. We do not share this information without your permission.

We will, therefore, process any data you enter onto the contact form only with your consent. You may revoke your consent at any time (cf. section 8). The data processed before we receive your request may still be legally processed.

We will retain the data you provide on the contact form until you request its deletion, revoke your consent for its storage, or the purpose for its storage no longer pertains (e.g. after fulfilling your request). Any mandatory statutory provisions, especially those regarding mandatory data retention periods, remain unaffected by this provision.

9.5 Google Analytics and browser plugin

Our website uses Google Analytics, a web analytics service. It is operated by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Google Analytics uses so-called "cookies". These are text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

Google will use this information in order to analyse your use of the website, to prepare reports about web activities for the website operator and to provide further services tied to website usage and Internet usage. To use Google Maps, it is necessary to save your IP address. This information is generally transmitted to a Google server in the USA and stored there. The provider of this site has no influence on this data transfer.

10. Updates and amendments of this data privacy statement

Parts of the data privacy statement may be amended or updated by us without notifying you in advance. Please review the respective data privacy statement before using our offering so you are up to date in case of amendments or updates.
